Terms and conditions

Last updated: 2026-11-04

Draft for legal review. Prepared under Polish law as at 2026. Before sales go live it must be completed with the seller details (marked "[TO BE COMPLETED]") and reviewed by a qualified lawyer. Not legal advice.

§ 1. General provisions

The online shop sklep.artumbra.pl, available at https://sklep.artumbra.pl (the "Shop"), is run by Bożena Wojtanowska, trading as "Bożena Wojtanowska Umbra Design", registered office: ul. Ryglicka 66, 33-170 Tuchów, Poland, tax no. (NIP): 993-007-48-65, REGON: 121841869, entered in the Polish CEIDG business register (the "Seller").

These Terms apply to all customers of the Shop and set out the rules for purchases, including concluding contracts of sale through the Shop, and for fulfilling orders by collection in person or by shipping.

The Terms are made available free of charge before a contract is concluded, in a way that allows them to be retrieved, reproduced and stored.

A customer may be a natural person with full legal capacity, a legal person, or an organisational unit with legal capacity.

§ 2. Definitions

Shop — the online shop run by the Seller at sklep.artumbra.pl.

Goods (Work) — paintings and other works of art presented in the Shop (originals, original prints, reproductions) that are the subject of a Sales Contract. Commissioned Work — a work made to the Customer individual specification.

Customer — an entity making purchases in the Shop (consumer or business).

Consumer — a natural person concluding a contract with the Seller not directly related to their business or profession. A sole trader concluding a contract of a non-professional nature is treated as a consumer.

Collection in Person — delivery by the Customer collecting the Goods at the Collection Point, after paying for the order or choosing payment on the spot.

Collection Point — the Seller studio at: ul. Krzyska 15b/2, 33-100 Tarnów, Poland, open by prior appointment (by phone or e-mail).

§ 3. Contact

E-mail: info@artumbra.pl, phone: +48 502 139 510. Correspondence address: ul. Ryglicka 66, 33-170 Tuchów, Poland. Collection and returns address: ul. Krzyska 15b/2, 33-100 Tarnów, Poland.

Phone contact is available on business days; call charges according to the Customer operator tariff.

§ 4. Technical requirements and subject of sale

To use the Shop you need a device with internet access, an up-to-date browser with JavaScript enabled and an active e-mail address. Cart contents are stored in the browser local storage and are not sent to the server until an order is placed. Adding a Work to the cart does not reserve it. The Customer must not provide unlawful content.

The items for sale are original works of art made by the artist. Each Work marked as an original exists in a single copy and, once sold, cannot be repeated.

Stated dimensions refer to the Work itself and do not include framing unless stated otherwise. Photographs reproduce colour as faithfully as photography allows; minor differences due to screen settings do not constitute a lack of conformity.

Sale of a Work does not transfer economic copyright or reproduction rights; the Customer acquires a physical copy. Copyright remains with the artist.

§ 5. Orders and prices

Orders may be placed 24/7 via sklep.artumbra.pl. Placing an order requires accepting these Terms and providing correct contact details needed to fulfil the order.

Prices are in Polish zloty (PLN), gross (including VAT where the Seller is a VAT payer). The price includes delivery within Poland (§ 8). The binding price is the one shown next to the Work when the order is placed.

Where a price reduction is announced, the Seller also shows the lowest price of that Work in the 30 days before the reduction (Omnibus Directive).

An order is placed by adding a Work to the cart and completing the order form. Clicking the "order with obligation to pay" button constitutes an offer to conclude a contract.

Because Works are unique, adding to the cart does NOT reserve them. Priority is determined by the moment of effective payment (or confirmation). If a Work is sold to another Customer in the meantime, the contract does not come into effect and any payment is refunded in full.

The Seller confirms acceptance of the order by e-mail; the contract is concluded upon confirmation. These Terms and the withdrawal notice are attached to that e-mail.

§ 6. Payment

Available payment methods: (1) bank transfer to the Seller account; (2) cash or card on the spot at the Collection Point; (3) electronic payment / instant transfer / BLIK via an external payment provider — once enabled in the Shop [TO BE COMPLETED], under that provider terms.

Seller bank account for transfers: Bank Millennium S.A., no. 30 1160 2202 0000 0005 1082 1470. Please quote the order number or the title of the Work.

For bank transfer, payment is due within 3 business days of order confirmation; otherwise the order may be cancelled.

For cash or card payment at the Collection Point, payment is made on physical collection. The Seller may withhold release of the Goods until the full amount is paid.

The Seller issues a proof of sale (receipt or invoice) in accordance with applicable law.

§ 7. Collection in person

The Shop offers Collection in Person of ordered Works at the Collection Point at no extra cost.

The Customer is notified by e-mail (from info@artumbra.pl) or by phone when the Goods are ready for collection. The collection time is agreed individually.

The Work should be collected within 14 days of the notification. After that period the Seller will contact the Customer to agree a new date; lack of contact may result in cancellation and a refund.

On collection the Customer should present the order number and give the name of the person who placed the order.

Because the Works are unique, the Customer is advised to inspect the packaging and the Work in the presence of the Seller on collection.

§ 8. Delivery (shipping)

Besides Collection in Person, the Seller offers courier shipping within the territory of the Republic of Poland. Shipping is free of charge — the delivery cost is borne entirely by the Seller. Carrier: [TO BE COMPLETED].

Shipping outside Poland is not offered; in such cases only Collection in Person or individual arrangements with the Seller are possible.

Large-format works (over 100 cm) are sent as oversized parcels; due to their size and fragility, the timing and method of delivery are agreed individually. Works are packed to protect the painted surface and edges.

The Seller dispatches the Work without delay after payment is credited, usually within 7 business days, unless stated otherwise.

For a Consumer, the risk of accidental loss or damage passes upon delivery of the item to the Consumer; if the Consumer chose a carrier not offered by the Seller — upon handing the item to that carrier. We recommend checking the parcel in the courier presence and drawing up a damage report if needed.

§ 9. Right of withdrawal (returns)

Under the Consumer Rights Act, a Consumer (and a sole trader treated as a consumer) who concluded a distance contract may withdraw without giving a reason within 14 days of taking possession of the Goods (for Collection in Person — from the day the Work is actually collected).

To meet the deadline it is enough to send the withdrawal statement before it expires to info@artumbra.pl or in writing to the correspondence address. Detailed rules, effects and the model form are set out in the separate "Right of withdrawal" document.

On withdrawal the Consumer must return the Goods (send them to, or deliver them to, the Collection Point) within 14 days of informing the Seller. The direct cost of returning the Goods is borne by the Consumer. Paintings are fragile — pack the Work properly for return transport.

The right of withdrawal does NOT apply to Works made to individual order or to the Customer specification (Art. 38(3) of the Consumer Rights Act) — this covers commissioned paintings, including portraits from photographs and made-to-measure works.

§ 10. Complaints — lack of conformity

The Seller must deliver Goods in conformity with the contract. For Consumers, the Seller liability is governed by the lack-of-conformity regime (Chapter 5a of the Consumer Rights Act), for non-conformity existing at delivery and revealed within 2 years.

The Consumer may request repair or replacement; where these are impossible or disproportionate, or in other cases set out in the Act, the Consumer may declare a price reduction or withdraw. For unique works, replacement is by nature not possible.

Complaints may be sent to info@artumbra.pl or in writing to the Collection Point address, with a description, date and photographs (for transit damage — photos of the packaging).

The Seller responds to a Consumer complaint within 14 days of receipt.

For non-consumer customers (B2B), statutory warranty (rękojmia) is excluded to the extent permitted by law.

§ 11. Personal data (GDPR)

The controller of Customers personal data collected through the Shop is the Seller. Data is processed to perform the sales contract, handle collection and shipping and — with separate consent — for marketing.

Customers have the right to access, rectify, erase, restrict, port and object. Details are in the "Privacy policy" available in the Shop.

§ 12. Out-of-court dispute resolution

A Consumer may use out-of-court complaint and redress procedures, e.g. permanent consumer arbitration courts, Trade Inspection (WIIH) mediation, or the municipal/district consumer ombudsman.

Information is available from the Polish competition and consumer authority (uokik.gov.pl). Use of these procedures is voluntary. The EU ODR platform was shut down on 20 July 2025 and is no longer available.

§ 13. Final provisions

Contracts concluded through the Shop are in Polish. Matters not covered are governed by Polish law, in particular the Civil Code, the Consumer Rights Act and the Act on providing services electronically. These Terms do not exclude or limit Consumer rights under mandatory law.

Disputes between the Seller and a Consumer are submitted to the courts competent under the Polish Code of Civil Procedure.

The Seller may amend the Terms for valid reasons; contracts concluded before a change are governed by the previous version.

The Terms apply from [TO BE COMPLETED]. The Polish version is binding; translations are for guidance only.
