Right of withdrawal

Last updated: 2026-11-04

Draft for legal review. Prepared under Polish law as at 2026. Before sales go live it must be completed with the seller details (marked "[TO BE COMPLETED]") and reviewed by a qualified lawyer. Not legal advice.

Deadline and rules

A Consumer (and a sole trader treated as a consumer) who concluded a distance contract may withdraw within 14 days without giving a reason and without costs other than those below.

The period starts when the Consumer (or a third party they indicate, other than the carrier) takes possession of the Work; for Collection in Person — from the day the Work is actually collected. Sending the statement before the deadline is sufficient.

The statement may be sent to info@artumbra.pl or in writing to: Bożena Wojtanowska Umbra Design, ul. Ryglicka 66, 33-170 Tuchów, Poland. The model form below may be used but is not mandatory.

Effects of withdrawal

The Seller refunds all payments without delay and no later than 14 days from receiving the withdrawal statement, using the same payment method the Consumer used, unless the Consumer expressly agreed otherwise.

The Seller may withhold the refund until the Work is returned or proof of return is provided, whichever is earlier.

The Consumer returns the Work within 14 days of withdrawal — by sending it to, or delivering it in person to, the Collection Point: ul. Krzyska 15b/2, 33-100 Tarnów, Poland. Direct return costs are borne by the Consumer, who is liable for any diminished value from use beyond what is necessary to assess the item. Pack the Work to prevent damage — paintings are fragile in transit.

Exclusion (commissioned works)

The right of withdrawal does NOT apply to non-prefabricated goods made to the Consumer specification or clearly tailored to their individual needs (Art. 38(3) of the Consumer Rights Act).

This covers commissioned paintings, including portraits from photographs and works made to measure. The terms of such a commission (deposit, timeline, specification) are agreed individually before work begins, and the Customer is informed that the right of withdrawal does not apply.
